Publicação de Editais
Caso o débito não seja pago no prazo estipulado, o imóvel é levado a leilão. São realizados dois leilões, e os editais devem ser publicados em jornais de grande circulação, contendo informações sobre o imóvel, o valor da dívida, os critérios para a sua realização, entre outros dados relevantes.
Realização dos Leilões
No primeiro leilão, o valor mínimo para os lances deve corresponder ao valor da dívida mais as despesas incidentes sobre a execução. Não havendo arrematante por valor igual ou superior ao da dívida, é realizado um segundo leilão, podendo o imóvel ser arrematado por valor inferior, desde que não considerado vil.
Quitação da Dívida ou Adjudicação
Se no segundo leilão o imóvel ainda não for arrematado, o credor pode optar por adjudicar o imóvel, ou seja, tornar-se proprietário do bem. Essa adjudicação é feita pelo valor da dívida, e o credor assume o imóvel livre de quaisquer outros ônus.

Para que a execução extrajudicial seja viável, alguns critérios e requisitos devem estar presentes:

Cláusula expressa no contrato de hipoteca prevendo a possibilidade de execução extrajudicial;
